Terms of Service

These Terms of Service (“Terms”) govern your use of Betacade, a playtest platform for web games operated by McDoCo, LLC. They cover playing games here and publishing them. By using Betacade, you agree to them.
Betacade is operated by McDoCo, LLC (“McDoCo,” “we,” “us,” “our”); learn more at mcdoco.com. “Betacade” or “the Service” means the play pages, player pages, studio pages, API and agent guide at betacade.com and its subdomains, and the sites games are served from. A studio is anyone who publishes a game on Betacade, including through an AI coding agent or other tool acting for them. A player is anyone who plays one. “You” means whichever you are, or both.

1. Who can use Betacade
You must be at least 13 years old to use Betacade. If you are under 18, or under the age of majority where you live, you may use it only with a parent's or guardian's permission. To publish games as a studio you must be at least 18 and able to enter a binding contract, and if you publish on behalf of a company or team, you confirm you are allowed to accept these Terms for it.
2. Accounts and sign-in
Players can play without an account. If you sign in, you do so with a code sent to your email address. You can keep using Betacade signed out at any time.
Studios sign in with an email code, and must have been let in from the waitlist (Section 3) to publish. A studio can create access tokens and approve an AI coding agent or other tool to act for it through the API. Anything done with your account or your tokens is your responsibility, including by an agent you approved. Keep tokens secret and revoke any you think have leaked.
Give us an email address you control, and tell us at hello@betacade.com if you think someone else has got into your account.
3. The studio waitlist
We are letting studios in gradually. When you sign in as a new studio, you join the waitlist, and we may ask you a few questions about your studio and your game. Joining doesn't guarantee access or a date; we decide who to let in and when. Being let in doesn't commit you to anything, and you can ask to be taken off the waitlist at any time. Playing is not waitlisted.
4. Playing games
Games on Betacade are made by studios, not by us. Many are unfinished: they may crash, lose progress or change between builds, and a studio may remove a game or a build at any time. Studios are responsible for their games' content. We don't review every game before it goes up, but we take action on games that break these Terms (Sections 7 and 9).
Games are free to play here. Your sharing choice decides what play data a game's studio sees, as our Privacy Policy describes. A studio may let you keep playing from a save, but saves are not guaranteed to work across builds or to be kept forever.
5. Your games and the licence you give us
You keep ownership of the games, builds, names, images and other material you publish (“Your Content”). You confirm you have the rights needed to publish it and to let players play it.
You give McDoCo a worldwide, non-exclusive, royalty-free licence to host, store, copy, serve, run, transmit and display Your Content, and to process the data it and its players generate, as needed to operate, secure and improve the Service. That includes injecting the play script into your builds, serving them to players, generating icons and install files from them, caching them on our providers' networks, and running them in the studio pages for replays. You also let players play your game through Betacade. The licence ends when you remove the content, except for copies in backups that roll off on their normal schedule and anything needed to comply with the law or resolve a dispute.
6. Your game's data and your players
You decide what your game stores in its saves, writes to the console, and sends as events. Betacade syncs and shows you what your game writes; it doesn't decide what that is. So you are responsible for:
- What personal information your game collects, and having a lawful basis for it.
- Telling your players about anything your game collects beyond what the Privacy Policy describes, and getting any consent the law requires.
- Not asking players for passwords, payment details or government identifiers inside your game.
- Using the play data you see only to make and support your game, keeping it secure if you copy it out of Betacade, and not trying to identify a tester behind their alias.
- Not asking testers for their contact details unless you have a real reason, and taking no for an answer.
We process play data to run the Service for you and for players, as the Privacy Policy describes.
7. Acceptable use for games
A game or build on Betacade must not:
- Contain malware, or anything designed to harm, take over, or use up the resources of a player's device (including cryptocurrency mining).
- Phish: pretend to be another site or service, or try to get sign-in details, payment details or other personal information under false pretences.
- Try to break out of its sandbox, attack Betacade, other games or players, or get at data that isn't its own.
- Contain or link to illegal content, including child sexual abuse material, or content that infringes someone else's intellectual property or privacy.
- Harass, threaten or incite violence against anyone, or exploit minors.
- Track players across other sites, or collect data for advertising or for sale.
- Use Betacade mainly to host files or a site that isn't a game.
You also must not get around rate limits, size limits or the waitlist, use someone else's account or tokens without permission, or use the Service in a way that breaks the law.
8. Feedback and messages
Players and studios can write to each other through Betacade. Be decent: no harassment, threats, hate, spam, sexual content directed at someone who didn't ask for it, or attempts to find out who someone is behind their alias. Studios: write to testers about your game, not to market unrelated things, and respect a tester who has blocked your messages. Players: feedback you send a studio can be used by that studio to improve its game, without owing you anything for it.
We don't read messages as a matter of course, but we may review them if they are reported to us or we need to for security.
9. Reports and takedowns
If a game or message breaks these Terms, or you think it infringes your rights, email hello@betacade.com with the game's link and what's wrong. For copyright, include enough for us to identify the work and the material, and your contact details.
We may remove or disable any game, build or message, or limit or suspend an account, if we believe it breaks these Terms or the law, or puts players or the Service at risk, with or without notice. Where it's safe to, we'll tell the studio what we removed and why, and give them a way to respond.
10. Our service and your feedback about it
The Service, its software, design and the Betacade name belong to McDoCo. These Terms don't give you any rights to them beyond using the Service. If you send us ideas or suggestions about Betacade, we may use them without obligation to you.
11. An early service
Betacade is new, and we are changing it often. We may add, change or remove features, set or change limits (such as build sizes, files per build, and how much history is kept), or stop offering the Service. Betacade is free today. If we introduce paid plans, we'll say so before charging anyone, and nothing you've published will start costing money without your agreement.
12. Disclaimers
THE SERVICE AND THE GAMES ON IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, THAT ANY GAME IS SAFE OR WORKS, OR THAT SAVES, PLAY DATA OR BUILDS WILL BE PRESERVED WITHOUT LOSS. KEEP YOUR OWN COPIES OF YOUR BUILDS.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, McDOCO AND ITS OFFICERS, MEMBERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE OR ANY GAME ON IT. McDOCO’S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
14. Indemnification
If you are a studio, you agree to indemnify and hold harmless McDoCo and its officers, members, employees and agents from any claims, liabilities, damages and expenses (including reasonable attorneys’ fees) arising out of Your Content, what your game collects from players, your use of the Service, or your breach of these Terms or the law.
15. Suspension and termination
You can stop using Betacade at any time. A player can delete their play data for any game from that game's Your data tab; anyone can ask us to close their account (see Data requests). A studio that wants its games or account removed can ask us at hello@betacade.com.
We may suspend or end your access, or remove your content, as Section 9 describes, or if we stop offering the Service. Where we can, we'll give studios notice first. Sections that by their nature should survive termination, including ownership, the licence for backups, disclaimers, limitation of liability, indemnification and governing law, will survive.
16. Changes to these Terms
We may update these Terms. We'll post the new version here and update the date above. For a material change to these Terms or the Privacy Policy, signed-in players and studios will be asked to accept the new version the next time they sign in. Otherwise, using the Service after a change takes effect means you accept it.
17. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in California, and you consent to their personal jurisdiction.
Before filing anything, please email hello@betacade.com with a short description of the problem. Most things can be sorted out that way, and we'll make a genuine attempt to.
18. General
Severability. If a provision of these Terms is held unenforceable, it will be limited or removed to the minimum extent necessary, and the rest stays in force.
No waiver. Not enforcing a provision is not a waiver of our right to enforce it later.
Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and McDoCo about the Service.
Assignment. You may not transfer these Terms or your account without our written consent. We may assign them to an affiliate or as part of a merger, acquisition, financing or sale of assets.
Electronic communications. We may send you notices about the Service by email to an address on your account, or by posting them in the Service.
Events outside our control. We are not liable for delays or failures caused by things beyond our reasonable control, including outages at a provider the Service depends on.
No third-party beneficiaries. These Terms create no rights for anyone other than you and McDoCo.
